Terms of Service

These Terms of Service ("Terms") govern your access to and use of digital products offered by Tuplebits LLC ("Tuplebits," "we," "us," or "our"), including project management templates, toolkits, and related digital assets (collectively, the "Products"). By purchasing, downloading, or using any Product, you agree to be bound by these Terms.

1. Eligibility

By using our Products, you represent that you are at least 18 years old and have the legal capacity to enter into a binding contract, or you are using the Products on behalf of an organization and have authority to bind that organization to these Terms.

2. Digital Products & Delivery

All Products are delivered as digital files only (for example: PPTX, DOCX, XLSX, PDF, or ZIP archives). No physical goods are shipped. After successful payment, you will receive access to download links either on the confirmation screen, by email, or both.

3. License & Permitted Use

Unless otherwise stated in the Product description, Products are licensed, not sold, for use by a single individual or a single organization. Subject to your compliance with these Terms, Tuplebits grants you a non-exclusive, non-transferable license to:

• Use and modify the Product for your own internal business or personal use.
• Incorporate the Product into your internal presentations, reports, and client deliverables as part of your services.

You may not:

• Resell, redistribute, or repackage the original files as templates, toolkits, or other digital products.
• Share the original files outside your organization or with third parties as stand-alone assets.
• Claim ownership or authorship of the original template design or structure.

4. Prohibited Uses

You agree not to use the Products:

• In any way that violates applicable law or regulation.
• To create competing template products or libraries derived primarily from Tuplebits Products.
• To misrepresent data, performance, or results in a manner that is fraudulent or misleading.

5. Payments, Taxes & Third-Party Platforms

Payments for Products may be processed directly on Tuplebits websites or via third-party platforms such as Etsy or payment processors. Prices, currencies, and applicable taxes will be shown at checkout. When you purchase through a marketplace or payment provider, their terms and policies may also apply in addition to these Terms.

6. Refunds

Because our Products are digital and accessible immediately after purchase, all sales are generally considered final. However, we want you to be satisfied with your purchase. If you experience technical issues accessing a Product or believe a listing was misleading, please contact us at tuplebits@gmail.com within 7 days of purchase and we will review refund or replacement requests on a case-by-case basis.

7. Intellectual Property

All intellectual property rights in the Products and the Tuplebits websites, including but not limited to designs, layouts, content, and branding, are owned by Tuplebits or its licensors. Except for the license expressly granted under these Terms, no other rights (including ownership) are transferred to you.

8. No Warranty

Products are provided "as is" and "as available" without warranties of any kind, whether express or implied. Tuplebits does not guarantee that any Product will meet your specific requirements, produce specific business results, or be error-free. You are responsible for validating and interpreting any data or outputs you generate using the Products.

9. Limitation of Liability

To the fullest extent permitted by law, Tuplebits will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to the use of or inability to use the Products, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Products will not exceed the amount you paid for the specific Product giving rise to the claim.

10. Updates to Products

From time to time, we may update or improve Products (for example, to fix issues or enhance layouts). We are not obligated to provide ongoing updates, but when updates are made available, we may choose to share them with prior purchasers at our discretion.

11. Changes to These Terms

We may update these Terms periodically, for example to reflect changes in our Products, business practices, or applicable law. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Products after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Tuplebits LLC is organized, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Products will be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless otherwise required by applicable consumer protection laws.
